Pre-Visits: Important Steps in Preparation for Mediation
Presenter: Deborah Bayless    1.0 hr. MCLE; 1.0 hr. KS CDRE
Meeting with individual participants prior to mediation is a good way to screen for power imbalances, domestic violence issues, and whether mediation is appropriate. It is also useful for determining the willingness of participants to listen to each other and to prevent impasse. The mechanics of pre-visits will be covered.

What is Bioethical Mediation & how does it work?

Patients, families, and health care providers can become enmeshed in conflict as they wrestle with decisions about life and death. Rachel will discuss the mediator’s role in  providing support for those charged with making health care decision and the patient's traditional and religious commitments and personal wishes. Bioethics mediation is an approach using interpersonal, mediative, conflict management, and dispute resolution skills merged with ethical principles to manage dilemmas arising in healthcare settings.

Understanding Conflict Dynamics for Effective Mediations

Understanding the biological and social drivers of conflict can provide valuable insights into the dynamics at play during disputes.  By exploring the genetic, physiological, and psychological factors that contribute to conflict escalation, mediators can have a more comprehensive understanding of the parties involved and their own responses to those parties. Identifying these key mechanisms can help mediators develop effective strategies to de-escalate conflicts, promote a calmer atmosphere, and encourage collaboration.  Mediators can create an environment that fosters open communication and facilitates the resolution of disputes.  By combining the understanding of conflict with established mediation practices, mediators can further enhance their ability to guide parties towards mutually agreeable solutions.

 A.I. as a Tool for Mediators
Presenter:  Prof. John Lande, JD  1.0 hr. MCLE; 1.0 hr. KS CDRE
A teachable A.I. coach can be a helpful tool for mediators for creating documents and summaries by clarifying thinking, sharpening language, and offering better drafts.  RPS coach is a writing partner that  permits the user to upload the writer’s works for analysis and to create the writer’s own style guide. This A.I. tools does not replace the writer’s thinking, it helps clarify what the writer actually wants to say.  The presentation will explore the values and design choices built into this A.I. tool, what’s in its knowledge base and how to use it, and why disclosure is a key ethical imperative in dispute resolution technology.  

Budget-Conscious Tech Tips and Tricks to Manage Your Mediation Practice
Presenter: Reshad Staitieth, JD   1.0 hr. MCLE; 1.0 hr. KS CDRE
This presentation will explore budget-conscious ways to use technology to improve small and growing mediation practice, with some demonstrations and time set aside for Q&A. Discussion will include video conferencing technology, case management options, website development/hosting and some marketing tools
